1. Who we are

Our activity needs no prior administrative authorisation and is not a regulated profession. We have not signed up to any code of conduct.

The prices of the Service are set out in the Terms. They exclude IVA (Spanish VAT). Where it applies, IVA is added at checkout.

2. What cataloop is and what this notice covers

cataloop is a wholesale selling platform that we provide as cloud software (the Service), at https://cataloop.app. A Seller publishes its Catalogue in a Shop, which has its own address within cataloop.app. Its customers, who are businesses and professionals, place their Orders without creating an account, and the Order reaches the Seller.

This notice governs the use of the site and of the Shops by anyone who visits them (the Visitor), whether a Seller, a Buyer or someone else. Other words with an initial capital have the meaning given to them in the Terms.

The Terms govern our relationship with each Seller. A purchase is a contract between the Buyer and the Seller, and we are not a party to it. Payment and shipping of Orders do not go through the Service: the Buyer and the Seller agree on them.

3. Who publishes each Shop

Each Shop is published by its Seller. The Catalogue, prices, photos and texts of a Shop are Seller Content, and the Seller is responsible for them.

The footer of every page of each Shop, including the Access code gate and the Order page, shows who the Seller is (registered name, tax ID, address and email) and links to the Seller's privacy information.

We host Seller Content, but we do not create it or review it before it is published. We are liable for it only if we have actual knowledge that it is illegal and do not promptly remove it or disable access to it (Art. 6 of Regulation (EU) 2022/2065, the Digital Services Act, DSA, and Art. 16 LSSI).

4. How to report illegal content

If you believe that content in a Shop or on the site is illegal, tell us at legal@cataloop.app or with the form at https://cataloop.app/contacto.

So that we can process it, your notice must include (Art. 16(2) DSA):

  • the reasons why you believe the content is illegal;
  • the exact address of the page where it appears;
  • your name and your email address;
  • a statement that you believe, in good faith, that the notice is accurate and complete.

You do not have to give us your name or email if the notice concerns child sexual abuse material.

We confirm that we have received the notice. A person on our team reviews it: we use no automated systems to decide on content. We then tell you, without undue delay, what we have decided and what redress is open to you.

5. Point of contact for authorities and users

The address legal@cataloop.app is our single point of contact for the authorities of the Member States, the European Commission and the European Board for Digital Services (Art. 11 DSA), and for those who use the Service (Art. 12 DSA). We handle it in Spanish and in English.

6. Rules for using the site

If you use the site or a Shop, do so lawfully and in good faith. In particular, you may not:

  • attack the site, overload it or try to enter parts you have no access to;
  • extract content automatically and in bulk;
  • get round the Access code of a private Shop;
  • send false Orders or Orders in someone else's name.

Access codes and Customer links are personal. If you receive one, do not share it with anyone else.

7. Intellectual and industrial property

The software, the design of the site and the cataloop name and logo belong to us. Seller Content belongs to the Seller.

No one may copy, distribute or transform these elements without permission from whoever holds the rights (consolidated text of the Spanish Intellectual Property Act, approved by Real Decreto Legislativo 1/1996).

8. Links to other sites

The site and the Shops contain links to third-party services:

  • WhatsApp, to write to the Seller. The link carries the Shop's number and, in some cases, a ready-written message that you can change before sending it;
  • videos that the Seller hosts on other sites. They load only if you press the play button;
  • the pages of our payment provider, where the Seller takes out and pays for its Subscription. The provider is on the Sub-processor list.

We do not control those sites and are not liable for their content. We are liable only if we have actual knowledge that linked content is illegal and do not remove the link diligently (Art. 17 LSSI).

9. Availability and liability

We aim to keep the site reasonably available, but we do not guarantee that it will work without interruptions or errors.

We are not liable for Seller Content, on the terms of the section "Who publishes each Shop".

10. Privacy and cookies

The Privacy policy explains how we process personal data. The Cookie policy explains which cookies and which browser storage the site and the Shops use.

When we process Buyer data on behalf of a Seller, we do so as processor, under the Data processing agreement, and with the providers on the Sub-processor list.

11. Governing law and courts

This notice is governed by Spanish law. If you are a consumer, you keep the protection that the law of the country where you live gives you, and you may go to the courts of your home.

12. Language and changes

This notice is published in Spanish and in English. If the two versions differ, the Spanish one prevails.

We may update this notice. The version in force is the one published on this page, with the date shown at the top.
